Last updated: September 24, 2026 · These Terms govern your use of nestfutureplan.com and all renovation services provided by Nest Future Plan.

1. Acceptance of Terms

By accessing our website, submitting an enquiry or booking form, or signing a service agreement, you agree to be bound by these Terms & Conditions, our Privacy Policy, and any project-specific contract. If you do not agree, please discontinue use of our site and services.

2. Our Services

Nest Future Plan provides home renovation management and construction services including, without limitation: home decor & interior design, exterior & garden renovation, home and fire security installation & maintenance, roof, solar and window installation, flooring, and bathroom remodeling. Specific scope, materials and deliverables are defined in each signed, fixed-price proposal.

3. Estimates, Quotes & Pricing

• Consultations, site visits and measurements are free of charge.
• Written proposals are fixed-price for 30 days from issue and itemize labor, materials, permits and fees.
• Prices on the website ("starting at") are indicative only and do not constitute an offer or binding quote.
• Change orders requested by the client are quoted and approved in writing before execution.

4. Booking, Scheduling & Site Access

Booking a consultation creates no obligation to hire us. Once a contract is signed, we guarantee the completion schedule stated therein; our on-time credit ($100/day, capped at 10% of contract value) applies only to delays caused solely by us and excludes force majeure, weather, permit delays, hidden structural defects discovered during demolition, and client-caused delays. Clients provide safe site access, utilities, and clearance of work areas as instructed.

5. Payments & Financing

Standard schedule: deposit at signing (typically 10–30% depending on project size and state law), progress payments at defined milestones, and final payment at walkthrough acceptance. Financing is offered through independent third-party lenders subject to credit approval; Nest Future Plan is not a lender and loan terms are governed by the lender's agreement.

6. Permits, Codes & HOA

Unless otherwise stated, we obtain required building permits and schedule inspections. Clients warrant they have authority over the property and will secure HOA approvals where applicable. Work complies with applicable local building codes in effect at permit issuance.

7. Warranties

• Workmanship: 5 years from handover on labor (1 year on Essential Refresh package).
• Structural: 10 years on structural modifications within Whole-Nest Future Planjects.
• Materials: manufacturer warranties pass through to the client; we assist with claims but are not the warrantor.
• Warranties exclude normal wear, misuse, neglect, unauthorized modifications, and acts of God.

8. Cancellation & Termination

Clients may cancel within any state-mandated cooling-off period (typically 3 business days for home-solicitation contracts) with full refund of unspent deposits. After material ordering or mobilization, cancellation fees equal documented costs incurred. Either party may terminate for material breach with 10 days' written notice and opportunity to cure.

9. Intellectual Property

Designs, 3D previews, drawings, photographs and website content remain our intellectual property until final payment, upon which clients receive a license to use project documents for personal, non-commercial purposes. We may photograph completed projects for portfolio use unless you opt out in writing.

10. Website Use & User Conduct

You agree not to misuse our site (scraping, malware, false enquiries, spam submissions). Form submissions must be truthful. We may suspend access for abuse and reserve the right to refuse service where lawful.

11. Limitation of Liability

To the maximum extent permitted by law, Nest Future Plan's aggregate liability arising from any project or website use is limited to the amount actually paid by the client under the relevant contract. We are not liable for indirect, incidental, or consequential damages including lost profits or temporary relocation costs, except where caused by our gross negligence or willful misconduct, and except for obligations that cannot be limited by Arizona law.

12. Indemnification

You agree to indemnify Nest Future Plan against third-party claims arising from your misuse of our website, misrepresentation of property ownership/authority, or unauthorized alterations to completed work.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law rules. Disputes will first be addressed through good-faith negotiation and, if unresolved, mediation in Yavapai County, Arizona; thereafter courts of Arizona have exclusive jurisdiction, except small claims eligible matters.

14. Newsletter & Communications

By subscribing you consent to receive monthly marketing emails. You may unsubscribe anytime via the link in each email or our Unsubscribe page. Transactional project communications are part of service delivery.

15. Changes to These Terms

We may revise these Terms periodically. Continued use of the website or services after publication of changes constitutes acceptance. The "Last updated" date controls the current version.
